Chapter 15 - Judith’s defense at trial

Judith rejected a plea initially.

She maintained the stair fall was accidental.

Trial began five months after the incident.

I testified.

Not theatrically.

I described:

Tray.

Statement.

Push.

Fall.

Graham’s request.

Current injuries.

Defense cross:

“You did not see Mrs. Bennett’s hands contact your back?”

“No.”

“You were wearing socks?”

“Yes.”

“Carrying a tray?”

“Yes.”

“Descending stairs?”

“I had not yet stepped onto first stair when I felt the push.”

“Could you have lost balance?”

“Not before she hit me from behind.”

Then the phrase:

“That’s the price for my son taking your side!”

No recording.

My testimony.

Defense said memory after traumatic fall can be affected.

True generally.

Then Graham testified under subpoena.

That was the moment Judith looked genuinely betrayed.

“Did you see your mother push Nora?”

“No.”

“Where was your mother?”

“At the top of stairs.”

“Where was Nora?”

“At bottom.”

“Did your mother say Nora slipped?”

“Yes.”

“What did Nora say?”

“That Mom pushed her.”

“Did you ask Nora to say she slipped?”

“Yes.”

“Why?”

“I panicked.”

“Had there been previous incidents where your mother physically touched Nora and Nora fell?”

He looked at Judith.

Then:

“Yes.”

Limited context admitted after legal arguments.

Not full character assassination.

Then Judith’s texts.

You choose which family you protect.

I grabbed her sweater.

Bathroom was the same. I was trying to stop her.

The jury heard.

Then Judith testified.

She said I hated her.

I did by then.

She said I was unstable on stairs.

No medical evidence.

She said she placed a hand on my shoulder to stop me after we argued.

Earlier:

She reached to catch me.

Now:

Stop me.

Prosecutor asked:

“Why were you stopping her?”

Judith paused.

“She was walking away.”

“Toward the stairs?”

“Yes.”

“While carrying a tray?”

“Yes.”

“Did you have permission to physically stop her?”

“No.”
