Chapter 11 - Madeline enters diversion
Juvenile intake reviewed Madeline’s conduct.
She had shoved Isla.
Smashed cake into her face.
Minor injury.
No prior record.
Age eleven.
Adult influence.
She admitted conduct.
Recommendation:
Informal diversion.
No juvenile-court petition if completed.
Requirements:
Six counseling sessions focused on aggression and peer conflict.
Community service through a supervised youth program.
No contact with Isla for ninety days unless Isla and both parents agreed.
Written account of what happened—not an apology letter forced onto Isla, but a factual reflection for the diversion officer.
Tessa accepted.
Madeline cried about missing the dance program more than community service.
That sounded shallow until Tessa explained:
Dance was where Madeline felt exceptional.
Vivian had attached obedience to the one thing the girl feared losing.
Tessa paid for a cheaper local program instead.
No Vivian money.
Then investigators considered Vivian’s role.
Could prosecutors charge her with solicitation or contributing to a minor’s delinquent conduct?
The evidence showed she instructed Madeline to push a chair and deliberately create confrontation.
That was enough for review.
No dramatic felony.
Eventually the prosecutor filed a misdemeanor contributing-to-delinquency/solicitation-type charge under the applicable state statute.
The cake escalation was Madeline’s own.
Vivian pleaded not guilty.
Separate from corporate case.
Then Isla.
She asked:
“Is Madeline bad?”
“No.”
“She smashed cake on me.”
“Yes.”
“That was bad.”
“Yes.”
“Then?”
“People can do bad things without being only bad.”
She frowned.
“Vivian?”
Harder.
“Same rule.”
Isla did not like it.
Neither did I.
