Chapter 12 - THE ELDER-ABUSE CASE

Police reviewed the security footage after Arturo’s attorney made a report.

My father did not want to.

At first.

“I’m not sending Dominic’s boy to jail.”

Helen Park answered:

“You are reporting conduct. Prosecutors decide charges.”

Arturo hated that sentence because it removed family control.

Exactly why it mattered.

Marcus had taken the watch without permission.

Value:

around thirty-four thousand dollars.

Potential felony theft depending on jurisdiction and proof of intent.

His defense:

He believed Arturo had effectively given it to him during prior conversations about succession.

Arturo denied that.

Then the watch had been taken and returned before.

Ambiguous.

The cane incident was clearer.

Intentional removal of a mobility aid.

Humiliating command.

Resulting loss of balance.

Minor knee bruising.

No fracture.

No hospitalization.

The prosecutor considered elder-abuse and battery-related charges.

No kidnapping.

No attempted murder.

No theatrical escalation.

Marcus eventually entered a negotiated plea to misdemeanor elder mistreatment and unlawful taking of personal property, with the watch-value count reduced in light of restitution, return, evidentiary dispute over permanent deprivation, and the broader plea.

Probation.

Counseling.

Community service with no elder-facing placement.

No unsupervised financial or caregiving role over Arturo.

No contact except through agreed family mediation for one year.

No jail.

Some relatives called that soft.

Arturo said:

“He is not a stranger who broke into my house. He is a man I helped raise who decided I was easier to manage than respect. I want the court to understand both.”

The judge did.

Then Marcus apologized in court.

Not:

I was under stress.

Not:

The deal mattered.

He said:

“I used his age to make him smaller.”

Good.

Then:

“I took an object from his body and a cane from his hand because I wanted him to feel finished.”

Better.

No forgiveness requested.

Specific.
