Chapter 14 - THE HEARING AVA DIDN’T ATTEND
The final custody hearing took place seven months after the reception.
Ava did not testify in open court.
The judge refused to turn a five-year-old into a spectacle.
Her forensic interview and evaluator’s report were admitted through professionals.
Melissa petitioned for guardianship.
Victoria requested reunification with intensive family services.
The court considered both.
Raffaele was called only as a fact witness regarding the reception and household incidents.
Victoria’s attorney tried to make the hearing about him.
“Mr. Caruso, are armed men regularly present at your residence?”
“Yes.”
“You have known associates with criminal convictions?”
“Yes.”
“Would you describe yourself as an appropriate model for a young child?”
Thomas objected.
The judge sustained.
Raffaele did not need to pretend he was something else.
His world had dangers.
That did not make Victoria’s abuse disappear.
When asked what he personally witnessed at the reception, he kept it simple.
Victoria forced Eli onto his knees.
Ava defended him.
Victoria shoved Ava.
Victoria tried to reach Eli again.
That was all.
The judge ultimately granted Melissa guardianship for twelve months subject to review.
Victoria retained supervised therapeutic visitation contingent on compliance with treatment.
A separate criminal case involving child endangerment and witness coercion remained pending.
Outside the courtroom, Melissa approached Raffaele.
It was the first direct conversation they had been allowed in months.
“Ava asks about Eli.”
Raffaele looked at her.
“He asks about her too.”
“The therapist thinks they can see each other again.”
He exhaled slowly.
“When?”
“Soon.”
Then Melissa added something he did not expect.
“She also asks about you.”
Raffaele had no answer.
Ava had almost become his daughter.
Then the truth broke the family apart before the wedding ever happened.
