Chapter 19 - Claire’s plea
Claire’s case resolved eleven months after the kitchen incident.
She pleaded guilty to one felony-level child-endangerment offense.
The unlawful-restraint count was reduced and resolved within the agreement.
Factors against her:
Eliza was five.
The compartment locked from outside.
Eliza asked to leave.
Claire intentionally prevented her.
Claire instructed Ethan to keep the situation secret.
Claire attempted to block me from accessing the child.
Factors in her favor:
Duration under one hour.
Food and water.
No physical injury.
No intent to keep Eliza there indefinitely.
No criminal history.
Immediate later cooperation after counsel.
Therapy.
Acceptance of responsibility.
Sentence:
Thirty days in county custody.
Remaining sentence suspended.
Two years supervised probation.
Required parenting and individual behavioral treatment.
No contact with Eliza except if later approved by Eliza’s guardian, therapist, and court.
No unsupervised care of unrelated minors during supervision.
Contact with Ethan governed by family court.
Not prison for twenty years.
Not nothing.
At sentencing, Claire said:
“I locked Eliza away because I wanted to delay a truth I was afraid of.”
There.
“I knew she wanted out.”
There.
“I asked my son to keep it secret.”
There.
“I had already hidden information about her from Ryan for almost two years.”
There.
Then:
“I told myself I was protecting my family. I was protecting my control over what my family knew.”
That was the clearest sentence she ever said.
I cried.
Quietly.
I did not ask the judge for more punishment.
I did not ask for less.
